TERMS OF SERVICE


By commissioning the artist, Faetyrr, for custom artwork, in any kind of way, you are agreeing to the terms of service outlined below

I. General Terms

1. The artist reserves the right to discontinue a commission at any time.
2. Terms are subject to change at any time for any reason, and will be effective immediately
3. The standard commission is of one character in the selected commission type with a white background. A version with a blank background can be requested at the time of commissioning.

II. Payment and Fees

1. Payment is due in full before any service is rendered
2. Payment will be taken solely through Paypal, unless alternate payment methods are discussed between the artist and the client.
3. Commission prices as listed on the Commissions page are subject to change as seen below. These changes are based on the artist's discretion.
Additional fees will be applied under the following conditions
a. COMPLEXITY FEE, applied if a commission's design is considered more complex than the average commission.
b. DESIGN FEE, applied if there are no reference images and the commission form request the artist to draw solely from a description and/or a collection of photos.
c. REVISIONS, applied for excessive or additional revisions to the commission (see V. Revisions)
d. ADDITIONS, applied for additions to the commission. This inclides extra backgrounds, characters, items, and characters,

III. Client Obligations

1. Write in a clear and concise manner when filling out the commission form.
2. Respond in a timely manner. If the client takes too much time to respond, the artist will remove your commission from priority.
3. Assume responsibility for any important information and clear descriptions/references you fail to provide me that results in my inability to complete your commission to your full satisfaction.
4. If you do not respond to any messages from the artist within a 7 day time period, your commission will be terminated with NO REFUND.

IV. Artist Obligations

1. The artist will deliver the agreed upon commission in a timely manner.
1.1. The artist will inform the client if anything prevents the commission from being completed in a timely manner.
2. The artist is obliged to inform the client if a particular commission request is not within the artist's specialty or general skillset.
3. The client will receive the following over the course of the commission's progress:
a. Final Sketch
b. Completed Commission
c. Completed Commission with png background (upon request)
The .psd file can be purchased for an additional $8

V. Revisions

1. One major revision during the sketch phase is included in the flat fee. Additional major revisions will incur additional fees.
2. Limited minor revisions during the sketch and rendering phase are included in the flat fee.
2.1. Excessive minor requests, at the artist's discretion, are subject to additional fees (see II. Payment & Fees).
3. Revisions due to artist negligence are considered free.
4. Constitution of minor and major fees are subject to the artist's discretion.

VI. Process

1. The client's commission will be added to the queue upon payment.
2. The artist will send a sketch to the client for approval before continuing the commission. One complete revision will be accepted at the sketch stage.
3. The sketch and subsequent progress shots will be sent in a lower resolution and will be watermarked.
4. Timelines will be established at the start of the commission process.
4.1. Timelines are not concrete and will be subject to change at the artist's discretion.
5. Any client requesting a commission on a quick deadline is subject to a RUSH FEE (see II. Payment & Fees)

VII. Copyright & Usage Policy

1. Any and all commissioned art must be credited to the original artist.
2. Works of art cannot be modified without the permission of the artist. Works cannot be distributed, mutilated or modified in any way that would prejudice the reputation of the Artist.
3. The artist reserves the right to publish any and all art created in a commission
4. Redistribution of my artwork for use in printed merchandise or as promotion of goods, services or social media pages is prohibited. Commercial use must be discussed with the artist prior to beginning the commission.
4.1. Commercial rights may be purchased at a price increase of 300%. With commercial rights, the client will be allowed to make any sort of merchandise with the artwork. Credit is still required for usage of the artwork, even if altered or edited.
Appropriate use of commissioned artwork
a.Print the work for personal use.
b. Crop and/or resize the image for use as an avatar, header, video thumbnail, etc.
c. Use the artwork as reference for a study.
d. Post the artwork on social media, with credit to the original artist
Prohibited use of commissioned artwork
a. Claim the artwork as created by anyone other than the original artist.
b. Removal of the official watermark/signature.
c. Paint over or otherwise alter the artwork in ways not covered under the allowed uses above.
d. Color in provided sketches or lineart (as provided in X. Process)
e. Use the commissioned piece in any technology related to NFTs, cryptocurrency, or AI.
f. Reproduce the work commercially without purchasing the rights from the original artist.

VIII. Refund & Cancellation Policy

1. A refund shall not be permitted once the finish commission is confirmed by the client.
2. A commission can be cancelled at any point before the final product. Appropriate refund percentages are listed below.
a. Sketch: 90%
b. Line: 50%
2.1 No refunds will be given for completed or nearly completed commissions.
3. The artist reserves the right to cancel a commission at anytime, for any reason, and without explanation.
3.1. If a commission is cancelled due to inability to complete on the artist's end, a full refund will be issued.

Definitions

"Original Artist" (also referred to as "Artist") refers to Faetyrr / Faetyrr.Official, who is the artist in the case of these Terms of Service
"Client" refers to any person(s) who commissions the artist
"Queue" means the order in which commission orders are processed
"Priority" means an order's closeness towards the front of the commission order, or "queue".
"You" referred interchangeably with "client", seen in III. Client Obligations.
"Service" refers to the process of commissioning a piece of art.
"Terms of Service" (also referred to as "Terms") means these Terms of Service that form the entire agreement between the client and the artist.
